The EB-5 visa is the most popular visa among foreign investors worldwide. By utilizing this visa, the general mindset of wealthy individuals overseas is to prepare for a long-term career and life plan. The U.S. has become a country where visas are much more difficult to obtain than expected. Even if someone does not have the intention of immigrating themselves, it is common for families or children to apply for the visa for educational purposes.

Purpose of Child’s Education
The most common reason for applying is for children to obtain a Green Card in order to receive an American education. By holding a Green Card, tuition fees are significantly reduced or even free (especially at universities). Additionally, if minors wish to study, it is common for one parent to accompany them, which is why many people obtain the visa for mother-child stays. -
Purpose of Child’s Employment Preparation
One key difference between the U.S. and other immigrant nations, like Australia, is that the annual issuance limit for visas quickly gets exhausted. As a result, the possibility of transitioning from a student visa (F-1) to a work visa (H1-B) is very low. In other countries, even if a job offer is made, without a visa, the student must return home after their studies.
Therefore, if one wishes to build a career in the U.S. after graduation, securing a Green Card beforehand means that, as long as a job offer is obtained, employment is possible. For those wishing to immigrate to the U.S., such as to Hawaii, one of the advantages of the EB-5 visa is that the requirements are minimal. Of course, working is allowed freely once the visa is obtained.
Main Criteria
You can apply using one of the following three options:
- Invest $1.05 million directly: Employ 100 U.S. workers within two years.
- Invest $800,000 directly: Invest in a region where the unemployment rate exceeds 150% of the U.S. average and create at least 10 direct jobs within two years.
- Invest $800,000 through a Regional Center: Invest in a new business within a USCIS-designated Regional Center and create at least 10 jobs (directly or indirectly) within two years.
For option 3, the investment is made in a program called a “Regional Center.” This is the most typical option for investors.
There are over 600 Regional Centers approved by the U.S. government, and investors must choose from these centers to proceed with the investment. AOM provides service for option 3
Regional Centers are established based on regional development and employment plans in each state. The types of investment projects handled by Regional Centers vary by state and cover a wide range of industries, including resort hotels, residential, logistic centers and infrastructure construction etc.
- There are no requirements for educational background, English proficiency, past business experience, or age restrictions.
- The investment funds must come from legally obtained sources.
- Applicants must pass a medical examination and background check.
About Investment
Direct Investment to Business (1 & 2)
- Make the necessary investment in a commercial business or enterprise within the United States.
- Create at least 10 full-time jobs for U.S. citizens or permanent residents.
- This investment must directly result in the creation of full-time staff positions from the applicant’s investment.
Investment through Regional Center (3)
- Make an investment in the selected project offered by Regional Center.
- There is no requirement to manage the investment project or operate the business personally.
Since business operations are not required, job creation can be calculated based on both direct and indirect employment.

Advantage of applying in the U.S
Individuals currently on student visa (F-1) or other types of visas can apply for EB-5 within the U.S. While the EB-5 application is under review, they could gain the rights to “work” and “travel in and out of the U.S. This enables applicants to work while awaiting their permanent residency approval.
